Description Job SummaryUnder technical direction, investigates and interprets highly complex environmental, asbestos, pollution and mass tort claims or reviews said claims for ceded reinsurance purposes. Determines direct or ceded liability, reviews direct or ceded coverages, arranges for inspections, negotiates and settles, pays or collects direct or ceded claim payments. Works within specific limits of authority on assignments of higher technical complexity and coordination.
Essential Duties & Responsibilitie
1. Negotiates highly complex settlement packages, cost share agreements, sets direct or ceded reserves and authorizes payment within scope of authority, settling claims equitably and ensuring timely issuance of disbursements.
2. Makes recommendations on claims handling policy and processes to management.
3. Manages all types of investigative activity on claims to include contact with insureds, witnesses, experts, agents, doctors, etc.
4. Coordinates discovery and litigation strategy with attorneys, including managing complex relationships with multiple parties (i.e. defense and coverage counsel, carriers, etc.)
5. Manages all aspects of complex reinsurance notification, billing and collection through analysis of direct claims activities, monitoring large loss notices, and interfacing with direct claims areas as well as reinsurance brokers and reinsurers.
6. Maintains compliance with state/federal regulations. Stays current with legal and industry trends.
7. Maximizes use of internal resources (i.e. Claim Litigation Technicians) to ensure optimal Total Claim Outcome. Interfaces with Litigation Management Unit.
8. May be responsible for special claims projects and presentations.
May perform additional duties as assigned.
Reporting RelationshipManager or aboveSkills, Knowledge & Abilitie
1. Solid knowledge of claims and insurance and reinsurance industry theory and practices.
2. Demonstrated technical expertise and product specific knowledge especially knowledge of life sciences or related technical discipline.
3. Strong interpersonal, communication and negotiation skills. Ability to effectively interact with all levels of CNA's internal and external business partners
4. Ability to work independently.
5. Strong analytical and problem solving skills.
6. Ability to exercise independent judgment and make critical business decisions effectively.
7. Knowledge of Microsoft Office Suite as well as other business-related software.
Education & Experienc
1. Bachelor's degree or equivalent experience. Professional designations or J.D. preferred.
2. Minimum three to five years claims experience focusing on environmental claims or mass tort.
